In a previous post, I mentioned the emigration of five possible brothers to early Virgina. They were Robert, Thomas, James, John, and Humphrey Vaus, Vause, Vaux, Vaulx (name appears in all these variants. Following are some records that pertain to Thomas. They are from York County records (extracted by Ben Weisiger) and VA Land Patents. Thomas Youll or Yowell (mentioned below in reference to Westmoreland County, VA)patented 500 acres in Westmoreland 19 Oct 1653. He came with his wife An Yowell Sr., Ann Yowell junr, Thomas Yowell, William
Yowell, William Yowell and himself as headrights to Thomas Hobkins (?Hopkins). His wife Anne was a daughter of Thomas Sturman.
It appears that Thomas' probable brothr, Robert Vaulx, married Elizabeth Burwell. He patented 6,000 acres in Westmoreland in Jun 1655, as well as tracts in York county, along Queens Creek just south of present-day Williamsburg, and also along Poropotank Creek which is the boundary between King and Queen and Gloucester Counties. Thomas Vaus died between 1650 and 1653 and it seems his brother Robert inherited his property by the terms of English common law, suggesting Robert was his older brother. Entries follow:
1647-This entry in Latin. Bill. 26 - 1647. THOS VAUSE of London, chirurgeon [i.e. surgeon, or doctor] is bound to Gerrard Hawthorne of Charleton Regis in Gloucester Co L100 legal English money. Signed THOMAS VAUSE. Wit: HUMPHRY VAUSE, Robt Thorndell. Records in IGI show the christening of a Jared Hawthorn on 14 Jul 1616 in Charlton Kings, Gloucester, England, son of Robert Hawthorn. A Robert Hawthorn was christened in Charlton Kings 12 Apr 1576, son of John Hawthorn. This is possibly father of Jared.
The indenture agreement reads: That Gerrard Hawthorne "shall be bound as a covenant servant" to THOMAS VAUSE "from hence forth until there first and next Arrivall in Virginia and then for the terme of three yeares" upon following condition. Vause to pay for Hawthorne's apparrell and all other necessaries and shall provide him sufficient working tooles of all sorts for the severall trads of a Carpenter Joyner and Cooper and shall not at his arrival into the Country
or afterwards at any time assigne or turne over the said Gerrard (without his owne consent) to any other person or persons to be there servant". At the end of the 3 year term Hawthorne to have his equipment, tools, etc., and 50 acres of land. No signature or witnesses in this entry.
1647/8, Jan 3-ROBT VAUS of Virginia, merchant, to "my Loveing Brother THO VAUSE and Lewis Burwell both of the same place" to collect debts and settle accounts in VA. Signed ROBT VAUS. Wit: HUMPHREY VAUSE, George Butler.
1648, Apr 18-patent granted to Mr. Lewis Burwell and THOMAS VAUSE for 2,300 acres
1648, Jul 21-Dorithy Wingatt, widow and relict of Roger Wingate "some tyme treasurer of Virginia Decd" grants to "my only and well beloved sonn LewisBurwell" all quit rents "due at the tyme of the decease of my said Husband Roger Wingate and confirmed unto me by his most excellent majesties gracious gift granted unto me under his Royal hand and signet at the Court of
Nottingham the last day of August in the Eighteenth yeare of his Raigne". Signed Dorethy Wingate. Wit: THUMAS VAUSE, HUMPHRY VAUSE. Note: in Oct 1633, Edward Kingswell with his partner Roger Wingate and their families and 40 other persons arrived in Jamestown on their way to establish a colony in Carolina. This venture failed. Kingswell and Wingate returned to England where they brought suit against Samuel Vassall and Peter Andrews who had contracted to to carry his party to Carolina but failed to do so. Roger Wingate, Kingswell's partner, brother-in-law and residuary legatee, returned to Virgina and was appointed treasurer of the colony in 1639, and office he held until his death in 1641. He married Dorothy, daughter of William Bedell of Catworth, county Huntingdon, and widow of Edward Burwell, of Harrington, county Bedford. His wife was the mother of Lewis Burwell, the emigrant member of the Virginia Family. There is a York County deed from Dorothy Wingate, widow of Roger, conveying to her "well-beloved son Lewis Burwell," all rents due at said Roger's deceased, and confirmed to her by the King. Records suggest that Elizabeth Burwell, daughter of Edward Burwell and
Dorothy Bedell, married Robert Vaulx of London and Virginia.
1648, Sep 22-THO VAUSE and Lewis Burwell, admrs of the est of James Stone deceased, on behalf of ROBERT VAUSE, cnfess to have rec'd of Tho Broughton, according to order of Court, an account of the estate of the said deceased. Signed THO VAUSE, Lewis Burwell. Wit: Tho x Steed.
1650, Oct 18-Sr. Wm. Berkeley, etc to THOMAS VAUSE gent 500 acres in Northumberland Co. on S side of Potomacke River at the mouth of a small creek that issueth out of Nominy river on the E side which divides this land
from that of John Tasker, etc.
1653, Oct 19-Thomas Youl, 150 acs. Northumberland Co., Upon S. side of Nomeny riv., bounded on Westernmost side with a creek which divides this & land of MR. THOMAS VAUSE, deceased & N.E. upon land of John Tasker. Trans of 3 persons.
1654, Jun 24. Power of Attorney. ROBERT VAULX, merchant, to "my well beloved friend" Tho Broughton to collect accounts in Counties of Northumberland, Lancaster, or Westmoreland. Signed ROBERT VAULX. Wit: Charles Edmunds his marke, Christopher Roberts. Recorded 20 Jul 1655.
1654, Jul 6. "Mr. Youll I understand that you are possessed of a seate of Land by Assignment from Richard Hawkins which my sister [Note: the term sister here probably refers to the wife of Thomas Vause/Vaulx, who was actually the sister-in-law of Robert Vaulx] gave mr. Brodhurst Order to make
sale of which is of no validity without me I being the lawful heire thereto. Now these are to Certify that I have given power to the Bearer Tho Broughton to make sale thereof and in respect you are seated thereon to have the refusal for present Tobco not else but rest Your loveing friend ROBERT VAULX From my house in Queens Creeke [York County] July 7 1654. 20 July 1655 this Letter was Recorded."
1655, July 20-Thomas Broughton, attorney of Robert Vaulx, assigns the above land to Tho Youll. "This same land being due unto the said ROBERT VAULX as heire at com'on law to the said THO VAULX." Dated 20 July 1655. Signed Thomas Broughton. Wit: Th Wilsford. Ack and rec 20 July 1655.
